ONBASE TERMS OF SERVICE

These Terms of Service (“Terms”) govern the access to and use of services provided through the OnBase mobile application, website, and all related digital platforms (collectively referred to as the “Platform”).
The Platform is owned and operated by OnBase, a technology platform that facilitates connections between Users and independent construction Workers and Professionals.
These Terms incorporate our Privacy Policy and any additional policies, guidelines, notices, and supplemental terms published on the Platform from time to time (“Supplemental Terms”). Together, these documents constitute a legally binding agreement between you and OnBase.
By accessing, browsing, registering on, or using the Platform, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms.
If you do not agree with these Terms, you must immediately discontinue use of the Platform.
1. PLATFORM OWNER
The Platform OnBase is owned and operated by OnBase, a sole proprietorship business operated by Parth Jethva, having its principal place of business in Ahmedabad, Gujarat, India.
For the purposes of these Terms:
- “OnBase”, “we”, “our”, or “us” refers to the Platform owner and operator.
- “User”, “Customer”, “Contractor”, “Builder”, “Site Owner”, or “Client” refers to any individual or business accessing or using the Platform to request Professional Services.
- “Worker” or “Professional” refers to an independent construction worker or construction professional registered on or connected through the Platform.
These Terms constitute a legally binding agreement between OnBase and every User accessing or using the Platform.
2. DESCRIPTION OF SERVICES
OnBase is a technology facilitator and aggregator platform that enables Users to connect with independent construction Workers and Professionals for on-site construction services.
IMPORTANT: OnBase is solely a digital technology platform that facilitates the connection between Users and independent construction Workers. OnBase does not itself provide construction services.
Through the Platform, Users may:
- Browse available Workers and Professionals
- Request construction Workers
- Schedule single-day or multi-day bookings
- Manage service bookings
- Process payments through supported payment methods
- View booking history
- Communicate regarding bookings where applicable
Workers and Professionals may provide services including, but not limited to:
- Brick Mason
- Block Mason
- Tile Mason
- Flooring Mason
- Plaster Mason
- Reinforcement (Steel/Fixing) Workers
- Centering/Shuttering Workers
- Construction Helpers
- Other construction-related services available on the Platform
These services are collectively referred to as “Professional Services.”
3. ROLE OF ONBASE
OnBase acts solely as a technology facilitator and aggregator platform.
The Platform enables Users to discover, schedule, and connect with independent construction Workers and Professionals.
OnBase is NOT:
- A contractor
- A subcontractor
- A labour supplier
- A construction company
- A project management company
- An engineering consultant
- A site supervisor
- An employer of Workers
- A staffing agency
OnBase does not:
- Perform construction work
- Employ construction Workers
- Supervise construction activities
- Control construction sites
- Inspect construction quality
- Guarantee project completion
- Guarantee Worker availability
- Guarantee Worker performance
- Guarantee Worker conduct
- Guarantee Worker attendance
- Guarantee project timelines
- Guarantee construction outcomes
All Workers available through the Platform operate as independent service providers.
Any agreement regarding Professional Services exists solely between the User and the Worker.
OnBase's responsibility is limited exclusively to facilitating the connection between Users and independent Workers through its digital Platform.
Nothing contained in these Terms shall create any employer-employee relationship, agency, partnership, joint venture, or contractor relationship between OnBase and any Worker.
4. ELIGIBILITY
To access or use the Platform, you represent and warrant that:
- You are at least 18 years of age.
- You possess the legal capacity to enter into binding agreements.
- You are legally authorized to engage Workers for construction services.
- All information provided by you is true, complete, and accurate.
OnBase reserves the right to refuse registration, suspend access, or terminate accounts where false, misleading, or fraudulent information is provided.
5. ACCOUNT CREATION
Certain features of the Platform require Users to create an account.
Users may be required to provide:
- Full Name
- Mobile Number
- Email Address (if applicable)
- Service Location
- Billing Information
- Other information reasonably requested by OnBase
You agree that:
- All information provided is true and accurate.
- You will promptly update any information that changes.
- You will maintain the confidentiality of your account credentials.
- You are solely responsible for all activities occurring under your account.
Users shall immediately notify OnBase of any unauthorized use of their account.
OnBase shall not be liable for any losses resulting from unauthorized account access caused by the User's negligence.
6. BOOKINGS
Users may request Professional Services by selecting:
- Service type
- Number of Workers required
- Booking duration
- Preferred schedule
- Service location
Booking Confirmation
A booking shall be considered confirmed only when:
- The booking request has been accepted by the Platform;
- Any required payment has been successfully processed;
- Confirmation appears within the User's account or booking dashboard.
Submission of a booking request does not guarantee Worker availability.
Worker Assignment
OnBase shall use commercially reasonable efforts to assign available Workers matching the requested booking.
However, Worker availability depends upon multiple operational factors including Worker availability, geographic location, acceptance of the assignment, workload, and unforeseen circumstances.
OnBase does not guarantee that a Worker will always be available for any requested booking.
Multiple-Day Bookings
Users may schedule Workers for one day or multiple consecutive days.
Each booking remains subject to Worker availability.
Worker Replacement
If an assigned Worker:
- cancels,
- becomes unavailable,
- fails to report,
- refuses the assignment,
OnBase may attempt to assign another available Worker.
However, OnBase does not guarantee replacement Worker availability.
Failure to provide a replacement Worker shall not constitute a breach of these Terms.
7. PRICING AND PAYMENTS
Users agree to pay all charges displayed on the Platform.
Charges may include:
- Worker service charges
- Platform service fees
- Applicable taxes
- Transportation charges (where applicable)
- Additional charges agreed directly between the User and Worker
Platform Role in Payments
OnBase only facilitates the connection between Users and Workers and may facilitate payment processing where applicable.
OnBase is NOT responsible for any payment disputes between Users and Workers.
Any dispute regarding:
- unpaid wages,
- additional work,
- overtime,
- cash payments,
- pending balances,
- transportation charges,
- extra work requested after booking,
shall be resolved directly between the User and the Worker.
OnBase shall bear no liability whatsoever for such disputes.
Transportation Charges
Transportation costs vary depending upon the construction site location.
The booking amount displayed on the Platform may include transportation charges for sites located within approximately 3 kilometres from the assigned Worker's pickup point.
Where the construction site is located beyond this distance, additional transportation charges may apply.
The User shall be solely responsible for paying such additional transportation costs directly to the Worker unless otherwise specified by OnBase.
OnBase shall not determine, negotiate, or be liable for transportation-related payment disputes.
Third-Party Payment Providers
Payments may be processed through third-party payment gateways.
OnBase shall not be liable for:
- banking failures,
- UPI failures,
- payment gateway downtime,
- transaction delays,
- payment reversals,
- technical errors caused by third-party payment providers.
8. CANCELLATIONS, RESCHEDULING & REFUNDS
Users may cancel or reschedule bookings through the Platform subject to the following terms.
Cancellation by User
Users may cancel a confirmed booking without any cancellation charges only if the cancellation is made at least eighteen (18) hours before the scheduled service time.
If a booking is cancelled less than 18 hours before the scheduled service time, OnBase reserves the right to charge cancellation fees or penalties depending on:
- Worker allocation
- Administrative costs
- Operational impact
- Time reserved by the assigned Worker
Any applicable cancellation charges shall be displayed on the Platform or communicated to the User.
Rescheduling
Rescheduling requests are subject to Worker availability.
OnBase does not guarantee that the same Worker or any replacement Worker will be available for the revised schedule.
Cancellation by Worker
Construction Workers are independent Professionals.
Occasionally, a Worker may cancel due to illness, emergency, transportation issues, personal reasons, weather conditions, or other unforeseen circumstances.
In such situations:
- OnBase will make commercially reasonable efforts to assign another available Worker.
- OnBase does not guarantee replacement Worker availability.
- Failure to assign another Worker shall not constitute any breach by OnBase.
Refund Policy
Refunds, where applicable, shall be processed according to the Platform's refund policy.
Platform service fees, cancellation charges, convenience fees, and certain operational charges may be non-refundable.
Refund processing timelines may vary depending upon payment providers.
9. USER CONTENT
Users may post reviews, ratings, comments, photographs, or feedback relating to Workers or Professional Services.
By submitting such content, Users grant OnBase a worldwide, perpetual, irrevocable, royalty-free, transferable license to:
- use
- reproduce
- publish
- display
- modify
- distribute
- promote
such content for operating, improving, and marketing the Platform.
Users represent that all submitted content:
- is truthful
- does not infringe third-party rights
- is not misleading
- complies with applicable laws
Users shall not post content that is:
- false
- defamatory
- abusive
- discriminatory
- threatening
- obscene
- fraudulent
- unlawful
- misleading
OnBase reserves the absolute right to remove any content without prior notice.
10. USER CONDUCT
Users agree to use the Platform responsibly and lawfully.
Users shall treat all Workers with dignity, fairness, and respect.
Users shall not:
- discriminate based on religion, caste, gender, ethnicity, language, nationality, or background
- threaten Workers
- verbally abuse Workers
- physically abuse Workers
- require Workers to perform illegal activities
- require Workers to perform dangerous tasks beyond their agreed responsibilities
- misuse the Platform
- attempt fraud
- interfere with Platform operations
Users are solely responsible for ensuring that the construction site provides a safe and respectful working environment.
11. ANTI-CIRCUMVENTION POLICY
Workers introduced through OnBase are connected through the Platform solely for bookings made using OnBase.
Users shall not:
- directly hire Workers after discovering them through the Platform
- bypass the Platform
- negotiate future bookings outside the Platform
- solicit Workers to avoid Platform service fees
Such conduct undermines the integrity and safety of the Platform.
Violation of this policy may result in:
- immediate account suspension
- permanent account termination
- restriction from future bookings
- legal action where applicable
12. INTELLECTUAL PROPERTY
All content made available through the Platform including:
- trademarks
- logos
- software
- source code
- graphics
- illustrations
- text
- layouts
- designs
- branding
- databases
is owned by or licensed to OnBase and is protected under applicable intellectual property laws.
Users shall not:
- reproduce
- distribute
- copy
- modify
- reverse engineer
- create derivative works
without prior written permission from OnBase.
13. CONSTRUCTION SITE SAFETY, LIABILITY & RISK ACKNOWLEDGEMENT
Construction work involves inherent risks including:
- injuries
- falls
- electrocution
- equipment accidents
- structural failures
- property damage
- permanent disability
- death
By booking Workers through the Platform, the User expressly acknowledges and agrees to the following:
13.1 OnBase is Only a Technology Facilitator
OnBase is solely a technology facilitator and aggregator platform that connects independent construction Workers with Contractors, Builders, Site Owners, Homeowners, and other Users.
OnBase does not control construction sites, supervise Workers, or participate in construction activities.
Accordingly, OnBase shall not be responsible for any construction-related incidents occurring at the worksite.
13.2 Responsibility for Site Safety
The User (including Contractor, Builder, Site Owner, Homeowner or Site Manager) is solely and exclusively responsible for maintaining a safe construction site.
This includes responsibility for:
- Site supervision
- Compliance with labour laws
- Compliance with construction safety regulations
- PPE (helmet, gloves, safety shoes, harnesses)
- Safe scaffolding
- Electrical safety
- Machinery safety
- Safe access to work areas
- Material handling
- Emergency response arrangements
OnBase has absolutely no responsibility for supervising safety at the worksite.
13.3 Site Accidents, Injuries & Death
The User expressly agrees that any accident, injury, illness, disability, permanent disability, hospitalization, property damage, or death occurring at the construction site shall be the sole responsibility of the User.
This includes incidents involving:
- Workers
- Contractors
- Visitors
- Third parties
OnBase shall not be liable under any circumstances for any compensation, damages, legal claims, criminal proceedings, or civil liability arising from such incidents.
13.4 Labour Insurance
Workers available through the Platform may not be covered under any accident insurance, medical insurance, life insurance, workers' compensation insurance, or employer liability insurance by OnBase.
Users are strongly advised to obtain appropriate insurance coverage for Workers engaged at their construction sites.
If the User chooses not to obtain such insurance, the User assumes all risks associated with accidents, injuries, disability, hospitalization, or death of Workers.
OnBase shall bear no responsibility whatsoever for insurance-related claims.
13.5 Compliance with Labour & Safety Laws
The User is solely responsible for ensuring compliance with all applicable:
- Labour laws
- Safety regulations
- Building regulations
- Municipal rules
- Environmental regulations
- Local government requirements
OnBase shall not be liable for any legal consequences arising from non-compliance.
13.6 Site Supervision
The User is solely responsible for supervising all construction work performed by Workers.
OnBase does not:
- inspect work
- supervise work
- provide engineering advice
- verify construction methods
- manage daily activities
Any supervision required shall be provided by the User or their appointed representative.
13.7 Quality of Work
Although OnBase endeavors to connect Users with verified Workers, verification does not constitute a guarantee of skill, workmanship, performance, conduct, or project outcomes.
OnBase does not guarantee:
- Quality of construction work
- Workmanship
- Project completion
- Structural integrity
- Technical accuracy
- Measurements
- Material usage
- Finishing quality
Users are solely responsible for inspecting and accepting completed work before making final payment.
13.8 Worker Attendance & Conduct
Workers are independent Professionals.
Accordingly, OnBase does not guarantee:
- Daily attendance
- Timely arrival
- Continuous availability
- Behaviour
- Professional conduct
- Communication
- Productivity
Any disputes regarding attendance or conduct shall be resolved directly between the User and the Worker.
13.9 Losses Due to Worker Performance
OnBase shall not be liable for any direct or indirect losses arising from:
- Worker negligence
- Poor workmanship
- Project delays
- Worker absenteeism
- Material wastage
- Incorrect execution
- Construction defects
- Damage caused during work
- Financial losses
- Loss of business
- Delay in project completion
The User assumes all risks associated with engaging Workers through the Platform.
13.10 Independent Professional Status
All Workers operate as independent Professionals.
Nothing contained in these Terms shall create:
- employment
- partnership
- agency
- labour contractor relationship
- principal-agent relationship
between OnBase and any Worker.
The User acknowledges that OnBase merely facilitates introductions through the Platform.
14. DISCLAIMERS
The Platform and all services made available through it are provided on an “AS IS” and “AS AVAILABLE” basis without any representations or warranties of any kind, whether express or implied.
To the fullest extent permitted under applicable law, OnBase expressly disclaims all warranties, including but not limited to:
- Merchantability
- Fitness for a particular purpose
- Accuracy
- Reliability
- Availability
- Non-infringement
- Continuous or uninterrupted access to the Platform
OnBase does not warrant or guarantee:
- Availability of Workers.
- Assignment of Workers for every booking.
- Completion of any construction work.
- Quality of workmanship.
- Timely completion of projects.
- Suitability of any Worker for a particular task.
- Conduct or behaviour of Workers.
- Attendance of Workers.
- Continuous availability of the Platform.
- That the Platform will be error-free or uninterrupted.
Although OnBase may verify certain information provided by Workers, such verification does not constitute a guarantee of competence, skill, experience, honesty, conduct, workmanship, or future performance.
Users are solely responsible for evaluating whether a Worker is suitable for their requirements.
15. LIMITATION OF LIABILITY
To the maximum extent permitted under applicable law, OnBase shall not be liable for any direct, indirect, incidental, consequential, exemplary, punitive, or special damages arising out of or relating to the use of the Platform or Professional Services.
Without limitation, OnBase shall not be liable for:
- Worker negligence
- Poor workmanship
- Construction defects
- Structural failures
- Incorrect execution of work
- Material wastage
- Project delays
- Missed deadlines
- Worker absenteeism
- Worker misconduct
- Worker performance
- Worker cancellation
- Payment disputes
- Transportation disputes
- Safety violations
- Site accidents
- Injury
- Disability
- Death
- Property damage
- Loss of business
- Loss of profits
- Loss of revenue
- Loss of goodwill
- Business interruption
- Indirect financial losses
- Claims made by third parties
- Legal proceedings between Users and Workers
OnBase shall not be responsible for any compensation payable to Workers, contractors, third parties, government authorities, insurance companies, or any other person arising from the use of the Platform.
The User acknowledges that construction activities involve inherent risks and assumes full responsibility for engaging Workers through the Platform.
In all circumstances, the maximum aggregate liability of OnBase shall not exceed the total Platform Service Fee actually received by OnBase for the specific booking giving rise to the claim.
Under no circumstances shall OnBase be liable for amounts exceeding such Platform Service Fee.
16. INDEMNIFICATION
The User agrees to defend, indemnify, and hold harmless OnBase, its proprietor, employees, representatives, affiliates, agents, technology partners, licensors, successors, and assigns from and against any and all:
- claims
- lawsuits
- liabilities
- damages
- penalties
- fines
- legal proceedings
- losses
- expenses
- legal fees
- advocate fees
- settlements
arising out of or relating to:
- misuse of the Platform;
- breach of these Terms;
- violation of applicable laws;
- disputes with Workers;
- payment disputes;
- transportation disputes;
- accidents at construction sites;
- injury or death of Workers;
- property damage;
- failure to maintain a safe worksite;
- labour law violations;
- safety law violations;
- negligence by the User;
- acts or omissions of the User.
This obligation shall survive termination of these Terms.
17. TERMINATION
OnBase reserves the right, at its sole discretion, to suspend, restrict, or permanently terminate any User account without prior notice if:
- these Terms are violated;
- fraudulent activity is suspected;
- misuse of the Platform occurs;
- illegal activities are detected;
- abusive behaviour towards Workers is reported;
- payment fraud occurs;
- attempts are made to bypass the Platform;
- any activity adversely affects the Platform or its users.
Termination of an account shall not affect any outstanding obligations or liabilities accrued before termination.
Users may discontinue use of the Platform at any time by ceasing to access or use the Platform.
18. FORCE MAJEURE
OnBase shall not be liable for any delay, interruption, failure, or inability to perform any obligation under these Terms resulting from events beyond its reasonable control, including but not limited to:
- natural disasters;
- floods;
- earthquakes;
- fire;
- pandemics;
- epidemics;
- government restrictions;
- strikes;
- lockouts;
- labour shortages;
- transportation disruptions;
- internet outages;
- telecommunications failures;
- cyber-attacks;
- server failures;
- power failures;
- riots;
- civil disturbances;
- war;
- terrorist acts;
- adverse weather conditions;
- Worker unavailability caused by unforeseen events.
During such events, OnBase's obligations shall remain suspended for the duration of the Force Majeure event.
19. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of India, including but not limited to:
- The Information Technology Act, 2000;
- The Indian Contract Act, 1872;
- The Bharatiya Nyaya Sanhita, 2023 (where applicable);
- Consumer Protection laws applicable from time to time; and
- Any other applicable laws of India.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue to remain in full force and effect.
20. JURISDICTION & DISPUTE RESOLUTION
Any dispute, claim, controversy, or legal proceeding arising out of or relating to these Terms, the Platform, or Professional Services shall first be attempted to be resolved amicably through mutual discussions.
If such dispute cannot be resolved amicably, the courts located in Ahmedabad, Gujarat, India shall have exclusive jurisdiction over all disputes.
The User irrevocably submits to the exclusive jurisdiction of such courts.
21. MODIFICATIONS TO THESE TERMS
OnBase reserves the right to modify, amend, update, or replace these Terms at any time without prior notice.
Updated Terms shall become effective immediately upon publication on the Platform unless otherwise specified.
Users are encouraged to periodically review these Terms.
Continued access to or use of the Platform after any modification constitutes acceptance of the revised Terms.

23. SEVERABILITY
If any provision of these Terms is held to be unlawful, invalid, or unenforceable by a court of competent jurisdiction, such provision shall be deemed severable and shall not affect the validity or enforceability of the remaining provisions, which shall remain in full force and effect.
24. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy, Supplemental Terms, and any other policies published on the Platform, constitute the entire agreement between the User and OnBase regarding the use of the Platform and supersede all prior understandings, communications, and agreements relating to the same subject matter.
25. WAIVER
Failure by OnBase to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. Any waiver shall be effective only if made in writing by an authorized representative of OnBase.
26. ELECTRONIC CONSENT
By accessing, registering, or using the Platform, the User acknowledges that they have read, understood, and agreed to these Terms electronically. Such electronic acceptance shall have the same legal force and effect as a handwritten signature under applicable laws.
